GENERAL TERMS AND CONDITIONS OF SALE OF THE SITE WWW.BUSTRONOME.COM

1. PURPOSE

The online sale of Vouchers on the site www.bustronome.com is for individuals and professionals. These general terms and conditions of sale (“GTCS”) are intended to govern exclusively all relations between the company Bustronome Limited, operating under the name “Bustronome”, limited company with a capital of GBP 25,000 of which the registered office is located at 6 Bevis marks, Bury court, EC3A 7BA LONDON, registered under the company number 10640814 (“Bustronome”) and its customers (as defined below). These General Terms and Conditions apply to the exclusion of any other document, with the exception of special conditions of sale which may be applicable. If such special conditions exist, they are specified on the presentation page of the event

2. ACCEPTANCE AND ENFORCEABILITY OF GTCS

The fact of making a reservation or a pre-reservation on the site entails acceptance and full acceptance of these GTCS, which you expressly acknowledge. As such, you waive any and all contradictory documents. Bustronome reserves the right to modify all or part of the GTCS at any time. You are therefore invited to regularly take note of the GTCS, which are permanently accessible on the link www.bustronome.com. If you do not accept the Terms and Conditions, you agree not to use the site or any of the services available on the site. The applicable GTCS are those in effect on the date of validation of the reservation

3. DEFINITIONS

“Voucher” means the official document produced by our system, which corresponds to a title and which proves that the customer, who is the holder, is entitled to board in the Bustronome whether it is for a Regular Service or where an Event takes place;
“Regular Service” means one of our sightseeing lunch, afternoon tea, dinner as defined on the Site under the category “Our Offer”. It features a standard departure time, itinerary, menu (applicable for a defined period), duration…;
“Customer” means any Internet user using the Bustronome services available on the Site, as an individual and / or professional;
“Personal Data” means your name, mailing address, e-mail address, telephone number, your connection details and, more generally, any data concerning you that is personal in the sense of the legislation in force in the UK and that is collected through the use of the Site;
“Event” means lunches, dinners or any other event (such as snacks, breakfast) that is open to the public and is produced or organized by the Organizer. Typically this would refer to larger number of people;
“Privatization” means lunches, dinners or any other event (such as snacks, breakfast) that is not open to the public and is produced or organized by the Organizer. Typically this would refer to larger number of people up to the full seating capacity and could be referred to as a “Private Hire” as opposed to a Regular Service;
“Pre-Booking Fee” means the fee for Pre-Booking an Event or a Privatization
“Reservation Fee” means the cost of booking a Voucher on the Site. In most of the situations the Reservation Fee will refer the Price but exceptions could be made where Bustronome accepts partial payments;
“Organizer” means any person organizing an Event or a Privatization on behalf of a group of people;
“Pre-Booking” means the service by which Bustronome allows customers to put an option to purchase Vouchers for an Event or a Privatization;
“Price” means the unit value of a Voucher; this value includes all taxes, service charge and Reservation Fee when relevant;
“Global Price” means the total amount of the cumulative Prices of the Vouchers that are the subject of a Reservation; this amount includes all taxes, service charge, Pre-Booking Fee or Reservation Fee when relevant;
“All-Inclusive” means the (Global) Price to which fees are added; this amount includes all taxes and service charge;
“Reservation” means any firm and definitive order of Vouchers carried out on the Site or over the phone;
“Site” means the website accessible via the url www.bustronome.com, regardless of the reception terminals (computer, television, telephone, smartphones, in particular I-Phone or Blackberry, tablets, in particular Ipad or Kindle, and other terminal allowing the reception, consultation and use of services of communication to the public online), and functionalities of these services (downloading, consultation, etc.), whatever the main destination (United Kingdom or abroad)

4. TERMS OF RESERVATION OR PRE-BOOKING

Depending on the situation, you may either make a Reservation (effectively a firm booking) and / or pre-book an Event, a Privatization. For bookings over 8 people, customer need to contact us and our Bustronome team
In both cases, you are invited to identify yourself and/or fill in your details
You agree that the information you enter in this registration process is accurate and correct

4.1 As part of a Reservation (firm booking)

You are invited to select the Regular Service, date, number of places you want from the list of “Our Offers” on the site
After selecting the Regular Service, the date and the number of places you want, a summary allows you to check the elements of the current Reservation
You must then check that these items correspond to your choice. If one of these items does not suit you, you can at any time click on the icon “Modify your order” and correct the elements of your selection
This summary is provided for information only and does not constitute a definitive reservation at this stage
Once you agree the summary of your selection:
– You are invited to read and accept these GTCS and any special sales conditions applicable. If this is the case, the said special conditions are specified. You must therefore read the summary in full to verify that you also accept the special conditions attached to it before definitively validating your order;
Copies of the GTCS applicable to your reservation can be sent to you by e-mail in PDF format.
– You are invited to pay online by credit card. For this purpose, the Reservation is blocked for a few minutes in order to allow you to make the payment. As soon as the payment is validated by Bustronome, an e-mail confirming your order is sent directly to you
Your order is final and binding only upon receipt of the confirmation email sent by Bustronome and accompanied by the Reservation purchased. A copy of the GTCS applicable on the day of your reservation can be sent to you in the confirmation email upon request

4.2 As part of a Pre-Booking

Pre-Booking an Event comprises – but does not limit to – the process described hereinabove
You are invited to select the Regular Service, date, number of places you want from the list of “Our Offers” on the site
In addition, there is a selection of extras you can select from the Site including special beverages from our wine list, birthday cakes…
Depending on the number of guests and the extra service you may require, and in order to confirm your Pre-Booking, you have the possibility:
– To call the following number: 0203 744 55 54 (cost of a local call);
– Or to make online payment of Pre-Booking Fees in accordance with the tariff schedule. These Pre-Booking fees will not be refunded in the event of cancellation
Once you have confirmed your Pre-Booking, there is no need to print out anything to show when coming at the Bustronome, your name is on our guests lists and is enough to give you access to the bus
It is important to note that in case of Pre-Booking where a fee has been agreed the payment of the saldo of the Global Price is done directly during the Regular Service where the selected Event takes place

4.3 As part of a Pre-Booking for a Privatization

Please read our description on the Site beforehand. You will be able to download special conditions in a pdf format
In order to confirm your Pre-Booking, you have the possibility to call the following number: 0203 744 55 54 (cost of a local call)
Once all the special conditions of the Private Hire are confirmed you will be able to pay a Pre-Booking Fee over the phone and confirmation will generally follow through email. The Pre-Booking fee will not be refunded in the event of cancellation

5. CHANGES OR CANCELLATION OF INDIVIDUAL (UP TO 8 PERSONS) RESERVATION AND REIMBURSEMENT

A Voucher cannot be refunded unless Bustronome decides to proceed with the refund of the Voucher. In such a case, you will be reimbursed directly by Bustronome. The refund is made for the price of the Voucher
As a general rule cancellation that intervene more than 1 day before the Regular Service and for a group of 8 or less will be reimbursed
Changes are possible subject to availability and prior approval of Bustronome
Apart from these conditions, no modification or cancellation of your booking can be made. As such the bus cannot wait for latecomers and refunds will not be given.
In case of cancellation or modification of the time, place or in case of postponement of the date of the Event, you will be informed by Bustronome with an e-mail sent to the address which you have communicated and / or if necessary by SMS sent to the mobile phone number you provided when creating your account.
It is specified that in case of postponement, no reimbursement can be made.
In any case and considering the risks associated with electronic messaging, Bustronome cannot guarantee that you will receive an email or an SMS. Therefore, Bustronome recommends that you check during the 24H that precedes the event.

6. CHANGES OR CANCELLATION OF AN EVENT FOR A GROUP (GREATER THAN 8 PERSONS) AND REIMBURSEMENT

The Events take place under the sole responsibility of the Organizer.
Vouchers cannot be refunded unless the Event has been cancelled and Bustronome decides to proceed with the refund of the Vouchers. In such a case, you will be reimbursed directly by Bustronome. The refund is made for the Global Price and no extra fees will be paid out
Changes are possible subject to availability and prior approval of Bustronome
Apart from these conditions, no modification or cancellation of your booking can be made. As such the bus cannot wait for latecomers and refunds will not be given
In the case of Pre-Booking, the Pre-Booking Fee is retained by Bustronome, including any modification or cancellation of the Event if, as a general rule, intervening in less than 10 days before the event.
In case of cancellation of the Event or modification of the time, place or in case of postponement of the date of the Event, you will be informed by Bustronome with an e-mail sent to the address which you have communicated and / or if necessary by SMS sent to the mobile phone number you provided when creating your account.
It is specified that in case of postponement of the Event, no reimbursement can be made.
In any case and considering the risks associated with electronic messaging, Bustronome cannot guarantee that you will receive an email or an SMS. Therefore, Bustronome recommends that you check during the 24H that precedes the event.

7. CHANGES OR CANCELLATION OF A PRIVATIZATION AND REIMBURSEMENT

For a Privatization or Private Hire, the same conditions will apply compared with the precedent point 6

8. AVAILABILITY OF PLACES

When ordering, you choose the number of seats corresponding to your wish. The seating plan is carried out according to the Organizer’s requirements in case of an Event subject to availability. Reservations are made in real time. Thus, during the ordering process, you are informed in real time of the availability. In case of unavailability, you will automatically be offered other available slots
For groups above 8 people please refer to the number of seats below

9. PRICES AND NUMBER OF SEATS

The Voucher price is indicated in pounds, all taxes and service charge included as defined in point 3
A Reservation Fee almost always refers to the full value of a Voucher. The Reservation Fee will be equivalent to the Price accordingly. Nevertheless in case of a partial payment – depending on circumstances & subject to approval of Bustronome – the Reservation Fee herein paid will come in deduction of the Price to pay for the Voucher concerned
In case of Pre-Booking, in a situation of an Event or a Privatization, the Pre-Booking Fees are a component of the Global Price
In the event of promotion or special offers, Bustronome agrees to apply the promotional Price to any Reservation made during the promotion period.
Bustronome reserves the right to modify the Prices at any time
The Bustronome has a seating capacity of 38 seats divided into tables of 2,4 and 6 people. As availability is concerned and information in real time (Refer to point 8), please note that group of people above 6 persons – typically Events – will be allocated more than one table. The seating plan is not available directly on the Site and can then be discussed calling the following number: 0203 744 55 54 (cost of a local call)

10. DIETARY REQUIREMENTS & BEVERAGES

We know how to cater for any type of nutritional constraints. However, it is necessary to notify us via the reservation form or on the telephone at 02037 445 554
It is important to note that the British regulation does not allow to sell alcohol aboard the bus but only to enjoy drinks you have pre ordered. Bustronome will allow customers to take opened bottle with content left with them also, Bustronome will refund any bottle ordered but left unopened

11. GIFTS

We have a gift card system in the form of a code, which will allow the recipient to come for a Regular Service according to their availability. The gift card is valid for Reservation for a period of 6 months following the normal procedure

12. ACCESS TO DISABLED PERSONS, CHILDREN & SAFETY CONDITIONS

The dining room is located on the upper deck of Bustronome, we cannot provide disability access unfortunately for this reason
Space is limited on board Bustronome so prams, bassinets and pushchairs are not permitted on board. Highchairs are not available either. However we will accommodate for children on the condition that we are notified in advance so we can reserve a larger table
We reserve the right, when necessary, to alter or withdraw on board services and facilities. More specifically Bustronome has the right to alter the specificities, length, itinerary of the tour in case of adverse weather conditions, road closures, social protests…
You must follow instructions given by our crew when on board Bustronome
For safety reasons smoking is not permitted on board
Bustronome may refuse to carry any passengers, or direct any passenger to disembark, where the behaviour of that passenger is liable to cause nuisance or offence to the other passengers or put at risk the safety of the passenger, other passengers, crew or coach
Bustronome will not be liable for any loss, damage or delay to any persons or their possessions whilst getting on board or disembarking from the coach or during the tour which may arise from or be in any way connected with any act, omission or negligence of any person employed by Bustronome
Bustronome will not be liable for death or personal injury to any persons resulting from any act or omission other than the Company’s negligence

13. TERMS OF PAYMENT AND SECURITY

Only online payment by credit card is accepted.
Credit cards accepted are Visa, Mastercard, Eurocard, American Express.
Payment by credit card allows you to book Vouchers online and immediately, firmly and definitively
The transaction is immediately debited to your credit card after verification of the credit card data, upon receipt of the debit authorization from the company issuing the credit card you use
By communicating your credit card information, you authorize Bustronome to debit your credit card from the amount corresponding to the all-inclusive Price or Global Price. As such, you declare to be the holder of the credit card to debit and that the name on the card is actually yours
In case the debit of the all-inclusive Price or Global Price is impossible, the online sale is immediately void by right and the Reservation cancelled
All payments made on the site are secured through our payment service provider, Barclays, which is the only recipient of your bank details
In addition, to protect you from fraud, your bank may ask you for an authentication code to verify that you are the owner of the bank card used

14. LIMITATION OF LIABILITY

You declare that you are fully aware of the characteristics and limits of the Internet network, by which Bustronome makes available the Site
You therefore agree that:
– The transmission of data over the Internet only carries relative technical reliability, as they travel on heterogeneous networks with varying technical characteristics and capacities, which are sometimes saturated at certain times of the day;
– Data circulating on the Internet is not protected against possible misappropriation and can be captured by the information disseminated
– It is impossible to control the use that could be made of it by third parties on the Internet
As a result, Bustronome cannot be held liable for any of the above events. Bustronome shall not be liable for any force majeure, including in particular the malfunction of the Internet, telephone lines, reception equipment preventing or hindering the use of the Site

15. YOUR OBLIGATIONS

By making a Reservation or Pre-Booking on the Site, you agree to comply with the provisions of the general terms and conditions of sale (“GTCS”) applicable at the time of your Reservation or Pre-Booking
Violation of the provisions of the GTCS by you may result in the suspension of access to the Site, without prejudice to any damages that may be requested by Bustronome
Consequently, Bustronome reserves the right to refuse any Reservation or Pre-Booking that contravenes or has contravened the provisions of the GTCS
You are responsible for all the data you enter directly on the Site. Bustronome draws your attention to the fact that it is up to you to put in place all the necessary measures to preserve the condidentiality of your personal data

16. PERSONAL DATA

The information and your personal data are required to manage your booking and our business relations, sending Bustronome.com newsletters and sending “email alerts”
Before you place your order, you must update your contact information and make sure that your personal data is free of errors. Indeed, we can contact you to inform you in case of modification of schedule or place of the event or its possible cancellation
The person responsible for processing the personal data is Bustronome.
The personal data collected and processed by Bustronome are confidential

17. COOKIES

When you connect to the Site, a cookie automatically installs on the hard drive of your computer via the navigation software
These cookies are very light text files that store information about your site browsing (pages viewed, date and time of logon etc.) from the computer where the cookies are stored
You have the possibility to oppose the registration of these cookies. To do this, you can use your browser’s privacy and / or security options (such as Firefox, Explorer, Chrome, etc.). However, Bustronome draws your attention to the fact that, in such a case, access to certain services on the site may prove to be altered or even impossible

18. INTELLECTUAL PROPERTY
18.1. Intellectual Property Rights on the Site

The Site and all elements that compose it, whether their structure, appearance or content (such as data, databases, texts, graphic texts, animated or non-animated images, sounds, drawings, graphics, logos, names, trademarks, designations, tabs, features, the content) are the property of Bustronome or are the subject of a rights grant granted for its benefit. The Site and its content are protected from any use not authorized by law or these GTCS
All rights to the Site and / or its contents (such as the right to reproduce, represent and / or distribute all or part of its content) other than those expressly granted under these GTCS shall be subject to express authorization from the holder of the rights in question. Consequently, any unauthorized use of the Site and / or its contents may be prosecuted on the basis of infringement and / or unfair competition and / or parasitism of the rights holder concerned

18.2. Intellectual property rights of third parties

All the elements of the Site downloaded by a third party in order to facilitate the visibility and the promotion of the events available on the Site are and remain the intellectual and exclusive property of the Site. No person is authorized to reproduce, exploit, re-broadcast or use, in any capacity whatsoever, parts of the site, whether software, visual or sound

20. EVIDENCE OF PROOF

You agree to communicate primarily with Bustronome electronically. The computerized registers of Bustronome are authentic and are considered admissible, valid and opposable proof of the communications, reservations, payments and transactions between Bustronome and yourself.
The same probative value is attributed to ticking the words “I wish to reserve these places definitively for the [date of the Regular Service/Event/Privatization] at [time of the Regular Service/Event/Privatization], [venue of the Regular Service/Event/Privatization] and I accept without reserve the GTCS. Reservations are non-cancellable, non-refundable
You agree not to challenge the admissibility, validity, effectiveness or probative force of the elements of a nature or electronic format mentioned above on the basis of their electronic nature. Unless proved otherwise, these elements will be valid and binding between Bustronome and yourself in the same manner, under the same conditions and with the same probative force as any document that would be established, received or retained in writing on a physical medium
