The online sale of Vouchers on the www.bustronome.com website is intended for private individuals and professionals. These general terms and conditions of sale ("GTCS") are intended to govern exclusively all relations between Bustronome NYC LLC, operating under the name "Bustronome", a company whose registered office is located at 60 Broad street 10004 New York city. These GTCS apply to the exclusion of any other document, with the exception of any special terms and conditions of sale that may be applicable. If such special conditions exist, they are specified on the event presentation page.
2. ACCEPTANCE AND PERFORMANCE OF THE CGV
By making a reservation or pre-reservation on the site, you accept and agree to be bound by these terms and conditions, which you expressly acknowledge. You hereby waive the right to rely on any contradictory document. Bustronome reserves the right to modify all or part of the GTC at any time. You are therefore invited to regularly review the GTC, which can be accessed at any time via the link www.bustronome.com. If you do not accept the GTCS, you agree not to use the site or any of the services available on the site. The terms and conditions applicable are those in force on the date the reservation is validated.
3. DEFINITIONS
"Voucher" means the official document produced by our system, which corresponds to a title and proves that the customer, who is the holder, has the right to board the Bustronome whether for a Regular Service or when an Event takes place;
"Regular Service" refers to one of our tourist lunches, afternoon teas or dinners as defined on the Site in the "Our Offer" category. It is characterized by a standard departure time, an itinerary, a menu (applicable for a defined period), a duration... ;
"Customer" refers to any Internet user using the Bustronome services available on the Site, as an individual and/or professional;
"Personal Data" means your name, your postal address, your e-mail address, your telephone number, your login details and, more generally, any data concerning you that is personal within the meaning of the legislation in force in the USA and that is collected as part of the use of the Site;
"Event" means lunches, dinners or any other event (such as snacks, breakfasts) open to the public and which is produced or organized by the Organizer. This generally involves a large number of people;
"Privatization" refers to lunches, dinners or any other event (such as snacks, breakfasts) that is not open to the public and is produced or organized by the Organizer. As a general rule, this involves a large number of people, up to the total seating capacity, which may be referred to as a "Private Hire" as opposed to a regular service ;
"Pre-booking fee" means the fee for pre-booking an event or privatization.
"Reservation Fee" means the cost of reserving a Voucher on the Site. In most cases, the Reservation Fee corresponds to the Price, but exceptions may be made when Bustronome accepts partial payments;
"Organizer" means any person organizing an Event or Privatization on behalf of a group of people;
"Pre-Reservation" refers to the service by which Bustronome allows customers to place an option to purchase Vouchers for an Event or Privatization ;
Price" means the unit value of a Voucher; this value includes all taxes, service charges and Booking Fees where applicable;
"Global Price" means the total amount of the cumulative Prices of the Vouchers subject to a Reservation; this amount includes all taxes, service charges, Pre-Reservation Fees or Reservation Fees where applicable ;
"All-Inclusive" means the (global) Price plus charges; this amount includes all taxes and service charges;
"Reservation" means any firm and definitive order for Vouchers made on the Site or by telephone;
"Site" refers to the Internet site accessible via the url www. bustronome.com, regardless of the reception terminals (computer, television, telephone, smartphones, in particular I-Phone or Blackberry, tablets, in particular Ipad or Kindle, and any other terminal allowing the reception, consultation and use of online public communication services), and the functionalities of these services (downloading, consultation, etc.), regardless of the main destination (USA or abroad).
4. BOOKING OR PRE-BOOKING CONDITIONS
Depending on the situation, you can either make a Reservation (in fact a firm booking) and/or pre-book an Event, a Privatization. For reservations of more than 8 people, the customer must contact us and our Bustronome team.
In both cases, you will be asked to identify yourself and/or fill in your contact details.
You agree that the information you enter in this registration process is accurate and correct.
4.1 As part of a Reservation (firm booking)
You are invited to select the regular Service, the date and the number of places you require from the list of "Our Offers" on the site.
Once you have selected the regular service, the date and the number of seats you require, a summary allows you to check the details of the current reservation.
You must then check that these elements correspond to your choice. If any of these elements do not suit you, you can click on the "Modify your order" icon at any time to correct the elements of your selection.
This summary is provided for information only and does not constitute a definitive reservation at this stage.
Once you have accepted the summary of your selection :
- You are invited to read and accept these GTC as well as any special terms and conditions of sale that may apply. If this is the case, the said special conditions are specified. You must therefore read the summary in full to check that you also accept the special conditions attached to it before finally confirming your order;
Copies of the GTC applicable to your booking can be sent to you by e-mail in PDF format.
- You are invited to pay online. For this purpose, the Reservation is blocked for a few minutes to allow you to make the payment. As soon as the payment has been validated by Bustronome, an e-mail confirming your order will be sent directly to you.
Your order is final and binding only upon receipt of the confirmation email sent by Bustronome and accompanied by the Reservation purchased. A copy of the General Terms and Conditions applicable on the day of your reservation can be sent to you in the confirmation email on request.
4.2 Within the framework of a Pre-Reservation for a Privatization

Each privatization must be paid in full before the day of the service.
5. MODIFICATION OR CANCELLATION OF AN INDIVIDUAL BOOKING (UP TO 8 PEOPLE) AND REIMBURSEMENT
A gift card can only be reimbursed if Bustronome decides to reimburse it. In this case, you will be reimbursed directly by Bustronome to the credit card used for payment. The refund will be equivalent to the value of the gift card.
As a general rule, if Bustronome were to cancel a tour, a full refund will be made on the day the tour is cancelled, if the customer were to cancel a tour less than 72 hours before the tour, Bustronome will make no refund, if the tour were to be cancelled more than 72 hours before the tour, Bustronome will offer the customer a gift certificate for the same amount with a validity of up to 18 months.
Changes are subject to availability and prior agreement with Bustronome.
Outside these conditions, no modification or cancellation of your reservation can be made. As a result, the bus cannot wait for latecomers and no refund will be made.
In any event, and given the risks associated with electronic messaging, Bustronome cannot guarantee that you will receive an email or SMS. Bustronome therefore recommends that you check 24 hours before the event.
6. MODIFICATION OR CANCELLATION OF AN EVENT FOR A GROUP (MORE THAN 8 PEOPLE) AND REIMBURSEMENT
Events take place under the sole responsibility of the Organizer.
Vouchers cannot be reimbursed unless the Event has been cancelled and Bustronome decides to reimburse the Vouchers. In this case, you will be reimbursed directly by Bustronome. The refund will be applied to the Total Price and no additional fees will be charged.
Changes are subject to availability and prior agreement with Bustronome.
Outside these conditions, no modification or cancellation of your reservation can be made. The bus cannot wait for latecomers and no refund will be made.
In the event of cancellation of the Event or modification of the time or place, or in the event of postponement of the date of the Event, you will be informed by Bustronome by an e-mail sent to the address you provided and/or, if applicable, by an SMS sent to the cell phone number you provided when creating your account.
It is specified that in the event of postponement of the Event, no refund can be made.
In any event, and given the risks associated with electronic messaging, Bustronome cannot guarantee that you will receive an email or SMS. Therefore, Bustronome recommends that you check during the 24H preceding the event.
7. MODIFICATION OR CANCELLATION OF A PRIVATIZATION AND REFUND
For Privatization or Private Rental, the same conditions apply as in point 6 above.
8. AVAILABILITY OF PLACES
When ordering, you choose the number of seats you require. The seating plan is produced according to the requirements of the Organizer in the case of an Event subject to availability. Reservations are made in real time. During the order process, you are informed in real time of availability. In the event of unavailability, you will automatically be offered other available slots.
For groups of more than 8 people, please refer to the number of places below.
9. PRICES AND NUMBER OF PLACES
The price of the Voucher is indicated in dollars, including all taxes and service charges as defined in point 3.
The Reservation Fee will almost always correspond to the total value of the Voucher. The Reservation Fee will be equivalent to the Price accordingly.
Le Bustronome reserves the right to modify the Prices at any time.
The Bustronome can seat 38 people at tables of 2, 4, 6 or 8. Subject to availability and real-time information (see point 8), please note that groups of more than 8 people - typically events - will be allocated more than one table. The seating plan for each service is managed by the Bustronome team.
10. DIETARY REQUIREMENTS AND BEVERAGES
We know how to respond to all types of nutritional constraints. However, it is necessary to notify us online or by telephone at 332 456 2955.
It is important to note that NYC regulations do not allow us to sell alcohol on board. Bustronome will NOT allow customers to take an opened bottle with its contents,
11. GIFTS
We have a gift card system in the form of a code, which will enable the recipient to come for a regular service depending on availability. The gift card is valid for one reservation for a period of 12 months.

12. ACCESS FOR THE DISABLED, CHILDREN AND SAFETY CONDITIONS
The dining room is located on the upper deck of the Bustronome. Unfortunately, we cannot provide disabled access for this reason.
As space is limited on board the Bustronome, baby carriages, cribs and strollers are not permitted. Highchairs are also not available. However, we can accommodate children if we are notified in advance so that we can reserve a larger table.
We reserve the right, if necessary, to modify or cancel services and equipment on board. More specifically, Bustronome has the right to modify the specifics, duration and itinerary of the tour in the event of unfavorable weather conditions, road closures, social protests, etc.
You must follow the instructions given by our crew when you are on board Bustronome.
For safety reasons, smoking is prohibited on board.
Bustronome may refuse to carry any passenger, or order any passenger to disembark, where the behaviour of such passenger is likely to cause a nuisance or offence to other passengers or to endanger the safety of the passenger, other passengers, crew or coach.
Bustronome shall not be liable for any loss, damage or delay suffered by persons or their property while embarking or disembarking from the coach or during the trip, which may result from or be related to any act, omission or negligence of any person employed by Bustronome.
Bustronome shall not be liable for death or personal injury.
13. TERMS OF PAYMENT AND SECURITY
Only online payment by credit card is accepted.
Payment by credit card allows you to reserve Vouchers online and immediately, firmly and definitively.
The transaction is immediately debited from your credit card after verification of the credit card data, and upon receipt of the debit authorization from the credit card issuer.
By providing your credit card information, you authorize Bustronome to debit your credit card for the amount corresponding to the Package Price or Total Price. In this respect, you declare that you are the holder of the credit card to be debited and that the name on the card is your own.
If it is impossible to debit the Fixed Price or the Total Price, the online sale is immediately null and void and the Reservation cancelled.
All payments made on the site are secured by our payment service provider, Barclays, which is the sole recipient of your bank details.
In addition, to protect you against fraud, your bank may ask you for an authentication code to verify that you are the cardholder.
14. LIMITATION OF LIABILITY
You declare that you are aware of the characteristics and limits of the Internet, through which Bustronome makes the Site available.
You therefore agree that :
- Data transmission over the Internet is only relatively reliable, as it travels over heterogeneous networks with varying characteristics and technical capacities, sometimes saturated at certain times of the day;
- The data circulating on the Internet are not protected against possible misappropriation and can be captured by the information disseminated.
- It is impossible to control the use that may be made of them by third parties on the Internet.
Consequently, Bustronome cannot be held liable for any of the above events. Bustronome shall not be held liable in the event of force majeure, in particular in the event of malfunction of the Internet network, telephone lines or reception equipment preventing or hindering use of the Site.
15. YOUR OBLIGATIONS
By booking online, you agree to abide by the provisions of the general terms and conditions of sale ("GTCS") applicable at the time of your Booking.
Violation of the provisions of the GTC may result in suspension of access to the Site, without prejudice to any damages that may be claimed by Bustronome.
Consequently, Bustronome reserves the right to refuse any Reservation that contravenes or has contravened the provisions of the GTSC.
You are responsible for all data that you enter directly on the Site. Bustronome draws your attention to the fact that it is your responsibility to implement all necessary measures to preserve the confidentiality of your personal data.
16. PERSONAL DATA
The information and personal data concerning you are necessary to manage your reservation and our commercial relations, to send newsletters from Bustronome.com and to send "email alerts".
Before placing your order, you must update your contact details and ensure that your personal details are correct. We may contact you to inform you of any changes to the time or place of the event, or of any cancellations.
Bustronome is responsible for processing personal data.
Personal data collected and processed by Bustronome are confidential.
17. COOKIES
When you connect to the Site, a cookie is automatically installed on your computer's hard drive via your browser.
These cookies are very small text files which store information about your browsing on the site (pages viewed, date and time of connection, etc.) on the computer on which the cookies are stored.
You have the option of refusing to accept cookies. To do so, you can use the confidentiality and/or security options of your browser (such as Firefox, Explorer, Chrome, etc.). However, Bustronome draws your attention to the fact that, in this case, access to some of the site's services may be impaired or even impossible.
18. INTELLECTUAL PROPERTY
18.1. Intellectual property rights on the Site
The Site and all of its components, whether in terms of structure, appearance or content (such as data, databases, text, graphics, animated or non-animated images, sounds, drawings, graphics, logos, names, trademarks, names, tabs, functionalities, content) are the property of Bustronome or are subject to a concession of rights granted for its benefit. The Site and its content are protected against any unauthorized use by law or by these GCU.
All rights to the Site and/or its content (such as the right to reproduce, represent and/or distribute all or part of its content) other than those expressly granted under these GTS are subject to the express authorization of the holder of the rights concerned. Consequently, any unauthorized use of the Site and/or its content may be prosecuted on the grounds of infringement and/or unfair competition and/or parasitism by the holder of the rights concerned.
18.2. Third-party intellectual property rights
All elements of the Site downloaded by a third party in order to facilitate the visibility and promotion of events available on the Site are and remain the exclusive intellectual property of the Site. No one is authorized to reproduce, exploit, rebroadcast or use for any purpose whatsoever any elements of the Site, whether software, visual or audio.
You hereby grant to Bustronome and where applicable to any subcontractor or agent of Bustronome (including IQ Engines, Inc) a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully-paid and transferable right and license, with the right to sublicense (in multiple tiers) all of your intellectual property and other rights in the content to copy, make derivative works from, distribute, transmit, publicly perform, publicly display, modify or adapt the content, in whole or in part, for any purpose, in any manner, using any media.

20. PROOF OF PROOF
You agree to communicate primarily with Bustronome by electronic means. Bustronome's computerized registers are authentic and are considered as admissible, valid and opposable proof of communications, reservations, payments and transactions between Bustronome and yourself.
The same evidentiary value is attributed to ticking the words "I wish to reserve these seats definitively for the [date of the regular service/event/privatization] at [time of the regular service/event/privatization], [location of the regular service/event/privatization] and I unreservedly accept the General Terms and Conditions of Sale. Reservations are non-cancellable and non-refundable.
You agree not to contest the admissibility, validity, effectiveness or enforceability of any of the above.
21. CHANGES TO EXCURSIONS / SERVICES
We reserve the right, if necessary, to modify or interrupt on-board services and facilities. In particular, Bustronome reserves the right to modify tour specifications, duration and itinerary in the event of adverse weather conditions, road closures, social events, etc.
22. RESTAURATION
Our services include the provision of food and beverages as part of the experience. Participation in services involving the preparation, purchase, service and consumption of food and/or beverages ("Catering") involves inherent risks, including health risks resulting from improper transportation, handling and storage, as well as food allergies that cannot be eliminated despite precautions taken to avoid injury. These specific risks vary and may include, but are not limited to, food allergies (known or unknown), thorough cooking of food; separation and absence of cross-contamination of food; proper refrigeration or cooling of food; cleaning of food, instruments and hands used in food preparation; and fire hazards. By accepting the Services, you, the persons for whom you have purchased tickets for any of the Services, your heirs, personal representatives or assigns, agents, employees and affiliates, and their heirs, legal representatives or assigns, agents, employees and affiliates, hereby assume all risks related to the Catering Service. The Bustronome Parties cannot assume or accept any risk or responsibility for the food allergies of persons participating in the Services, whether or not they have been informed of such allergies.
In consideration of your authorization to participate in the Services where prepared, cooked, perishable or other foods are transported, prepared and consumed, you, your heirs, personal representatives or assigns, agents, employees and affiliates hereby release, waive, discharge and covenant not to sue the Parties Bustronome, its affiliates, direct or indirect, officers, employees and agents, from any liability for any claims resulting from bodily injury, accident or illness (including death) and property loss arising out of, but not limited to, participation in the Services.
